Permission: This photograph is subject to the provisions of Italy's Law for the Protection of Copyright and Neighbouring Rights because it was either created in Italy or may be considered an Italian work within the meaning of Italian law (Art. 189). Italian law makes an important distinction between "works of photographic art" and "simple photographs" (Art. 2, § 7). Works of photographic art are protected for 70 years after the author's death (Art. 32 bis), whereas simple photographs are only protected for a period of 20 years from creation (Art. 92). Simple photographs are defined by the law as "images of persons, or of aspects, elements or events of natural or social life, obtained by photographic or analogous processes, including reproductions of works of figurative art and stills of cinematographic film" (Art. 87). If this image meets the definition of a simple photograph and was created prior to 1976 and published without a copyright notice before 1 March 1989, then it was out of copyright in Italy on the date of restoration (January 1, 1996) and is currently in the public domain in the United States (17 U.S.C. § 104A). Outside the US, reusers may need to check the copyright status of this image in their local jurisdiction. Full source, publication date and authorship information should be provided. Because Italy has long-standing copyright relations with the United States, some Italian works might have a subsisting U.S. copyright. In such a case, the works in question are not in the public domain in the U.S. even if they meet the above conditions. This file is NOT necessarily in the public domain in the United States because a non-simple image can only be in the public domain in the U.S.: if it entered the public domain in Italy prior to 1996, or when, after that date, its copyright term expires in accordance with U.S. law. Information about the creation date and creator should be provided. If the image is not in the public domain in the United States, in addition to the license tag for its status in Italy an appropriate fair use license and rationale should be provided, or the image should be proposed for deletion. If the media is in the public domain in both Italy and the United States, it may be transferred to the Wikimedia Commons. Note: If this image is in the public domain in the U.S., modify the end of the copyright tag from }} to |commons}}. This will replace the preceding U.S. copyright notification with a nomination for this image to be moved to the Wikimedia Commons. This image may not have the proper copyright or licensing information, or there is a conflict of license. An experienced editor should contact the uploader and add the proper tag, or discuss the issue on the talk page. If the image has no source, add {{subst:Di-no source}}. If the image has no licensing information, add {{subst:Di-no license}}. If the copyright tag may need discussion, please list at Wikipedia:Files for discussion.
