The image that appeared in McKelvey's original article was accompanied by a caption (see above) that indicated the image was reproduced from an Ellwanger & Barry catalogue from 1860 (Ellwanger and Barry, Descriptive catalogue of fruits, Rochester, 1860), thus placing it unambiguously in the public domain.
