Permission: Under the terms of the 1909 Copyright Act the photo would have had to be renewed 28 years after publication. A search for copyright renewal records of 1970 ([1]) reveal no trace that this occurred. This work is in the public domain because it was published in the United States between 1923 and 1963 and although there may or may not have been a copyright notice, the copyright was not renewed.
