Choosing the Menteri Besar
The rules of the state say that the Sultan of Kelantan chooses the Menteri Besar. The Sultan picks someone from the Kelantan State Legislative Assembly. This person must have the support of most members in the Assembly. They must also be an ethnic Malay and follow the religion of Islam. They cannot be a Malaysian citizen by becoming one later or by registration.
After choosing the Menteri Besar, the Sultan also picks a team of 4 to 10 other members. These members also come from the Legislative Assembly.
Taking the Oath
Before starting their jobs, the Menteri Besar and their team must make a promise. They promise to do their job well and keep important information secret. This promise is made in front of the Sultan.
The Menteri Besar and their team work together and are responsible to the Legislative Assembly. They cannot have other jobs that might cause problems or unfairness.
When a Menteri Besar Steps Down
If the government's budget is not approved by the Legislative Assembly, or if the Assembly votes that they no longer trust the government, the Menteri Besar usually has to step down right away. The Sultan will then choose a new Menteri Besar based on the situation.
Other team members serve as long as the Sultan wishes. The Sultan can also remove any team member if the Menteri Besar suggests it. If a Menteri Besar resigns, loses an election, or passes away, the Sultan will usually appoint the new leader chosen by the ruling party.
What the Menteri Besar Does
The Menteri Besar has a lot of power, but there are also limits. If the Menteri Besar is no longer the leader of their party, or if the government loses a vote of no confidence, they must suggest a state election or resign. The Sultan can also dismiss them.
If the government cannot get its money-spending plans approved, or if important laws are not passed, it often means the government should resign. This is because a government cannot work without money.
The Menteri Besar's party usually has the most members in the Legislative Assembly. Because party members in Kelantan often vote together, it's usually easy for the government's laws to pass.
Caretaker Government
The Legislative Assembly usually lasts for five years from its first meeting. However, the Sultan can dissolve it earlier if the Menteri Besar advises it. After the Assembly is dissolved, a new election must be held within 60 days. The new Assembly must meet within 120 days.
During the time between the old Assembly ending and the new one starting, the Menteri Besar and their team stay in office. They act as a "caretaker government." This means they keep things running smoothly until a new government is officially formed.
