The Constitutional Court of Romania (Romanian: Curtea Constituțională a României) is a very important court in Romania. Its main job is to make sure that all new laws, rules, and government decisions follow the country's main rulebook, called the Constitution. Think of the Constitution as the supreme law that guides everything else.
This court has nine members, who are like judges. They serve for nine years and cannot serve again. Three members are chosen by the President, three by the Senate, and three by the Chamber of Deputies. Every three years, three new members join the court.
What does the Court do?
The Constitutional Court has several important jobs. It makes sure that everything the government does follows the rules set out in the Constitution. Here are some of its main responsibilities:
- Checking New Laws: Before a new law is officially put into action, the Court checks if it matches the Constitution. This can happen if the President, the Government, or a certain number of lawmakers ask the Court to check.
- Checking Parliament's Rules: The Court also checks the rules that the Parliament uses to do its work. This ensures Parliament follows its own rules and the Constitution.
- Looking at Old Laws: If someone in a regular court case thinks a law is unconstitutional, the Constitutional Court can step in to decide.
- Presidential Elections: The Court watches over the election of the President of Romania. It makes sure the election process is fair and confirms the final results.
- Presidential Issues: If there's a situation where the President can't do their job for a while, the Court figures out why and tells Parliament and the Government.
- Suspending the President: If there's a proposal to temporarily remove the President from office, the Court gives its advice on the matter.
- Referendums: The Court oversees national votes (called referendums) to make sure they are organized correctly and confirms their results.
- Citizen Initiatives: It checks if citizens who want to propose a new law have followed all the necessary steps.
- Political Parties: The Court decides if a political party is following the Constitution.
Who are the members?
The Constitutional Court has nine members. Each member is appointed for a nine-year term. They are chosen by different parts of the Romanian government:
