Miguel Reale (born November 6, 1910 – died April 14, 2006) was an important Brazilian thinker. He was a jurist (someone who studies law), a philosopher, a teacher, a politician, and even a poet. Many people consider him one of Brazil's most important legal experts.

Miguel Reale was also involved in a political movement called Integralism in Brazil. He helped lead this group and shaped its ideas.

In 1947, Reale served as the Secretary of Justice for the state of São Paulo. He later started the Brazilian Institute of Philosophy in 1949 and the Inter-American Society of Philosophy in São Paulo in 1954. He was also a member of the respected Brazilian Academy of Letters.

Early Life and Education

Miguel Reale studied at the Law Faculty of the University of São Paulo. He graduated in 1934. Later, he became a professor there in 1941. He even served as the rector (the head of the university) twice, from 1949 to 1950 and again from 1969 to 1973. The University of São Paulo also gave him the special title of professor emeritus.

As a scholar, Miguel Reale became very well known. His work on law and philosophy was recognized across Latin America and in Europe.

Key Ideas and Contributions

Miguel Reale wrote many important books about law and philosophy in Brazil. Some of his famous works include Philosophy of Law and Preliminary Lessons of Law.

The Three Dimensions of Law

One of his most famous ideas is the three-dimensional theory of law. This theory explains that law has three main parts:

  • Social fact: This is about how society works and what people do.
  • Value: This refers to what society believes is right or wrong, or what is important.
  • Legal norm: This is the actual rule or law that is created.

Simply put, Reale believed that a social fact (something happening in society) is looked at based on its value (whether it's good or bad). Because of this, a legal rule or law is then created. These three parts are connected in a special way that helps create and understand laws.

Shaping Brazilian Law

In 1969, Brazil's president asked Miguel Reale to join a special group. This group was tasked with reviewing and updating the country's 1967 Constitution. Their work led to an important change in the Constitution in 1969.

Later, in 2002, Miguel Reale played a very big part in writing Brazil's current Civil Code. This is a major set of laws that covers many parts of everyday life, like contracts and family matters. He is seen as the main person behind this important law, which became Law 10.406/2002.

Involvement in Philosophy

Miguel Reale was also very active in the world of philosophy. He helped start the Brazilian Institute of Philosophy in Lisbon, Portugal. He organized seven Brazilian Congresses of Philosophy between 1950 and 2002. He also organized the VIII Inter-American Congress of Philosophy in Brasília in 1972.

He was a special speaker at several World Congress of Philosophy events in different countries. He also organized and led other important philosophy congresses in Brazil.
