The title Lord Falconer of Halkerton was created in Scotland on December 20, 1646. It was given to Sir Alexander Falconer, who was a very important judge called a "Lord of Session." This title was meant to be passed down through his family, specifically to his male heirs. King Charles I also gave Sir Alexander a yearly payment of £200 along with the title. This was because the King trusted Sir Alexander's skills, honesty, and dedication to fairness in the justice system.

The famous Scottish philosopher David Hume had a connection to this family. His mother was a great-granddaughter of a brother of the first Lord Falconer.

Later, in 1778, the 7th Lord Falconer also inherited another important title, the Earldom of Kintore. This meant that for a long time, the titles of Lord Falconer and Earl of Kintore were held by the same person. This continued until 1966. When Arthur George Keith-Falconer, who was both the 12th Lord Falconer and 10th Earl of Kintore, passed away, the Lordship of Falconer became "vacant." This means there was no clear person to inherit it. However, the Earldom of Kintore continued to be passed down through the female side of the family.

Peter Serrel Falconer, who was an architect and passed away in 2003, was thought to be the next in line for the old feudal barony (from 1206) and the Lordship of Halkerton (from 1646). He had three sons (Thomas, Richard, and William), but he never officially claimed the titles.
